
On 24 November 2022, Van Olmen & Wynant, in collaboration with the Institute for Company Lawyers (IBJ/IJE), organised an Employment Forum on the topic of protective/restrictive clauses in employment contracts and service agreements. The Forum, held at De Warande in Brussels, attracted an audience of over 50 in-house legal counsels, HR managers and other HR and legal professionals.
VOW Partner Nicolas Simon and Senior Associate Séverine Vincke, both members of our Employment team, had the honour to present their views on the topic. The presentation focused on the legal rules, practices and case law regarding four restrictive clauses: the exclusivity clause, the non-compete clause, the confidentiality clause and the schooling clause. These restrictive clauses have always been an important point of discussion in employment labour, the Act of 7 October 2022 which transposes the European Transparent and Predictable Working Conditions Directive has introduced new rules concerning exclusivity and schooling clauses. Therefore, it was the ideal moment to address this topic.
The presentation led to an interactive disccusion with the audience, and was followed by a marvelous networking lunch.
