On 10 March 2023, Sofya Buelens and prof. dr. Liesbeth Todts (both members of the VOW civil servants’ team) spoke at the Abilways Conference on Public Sector Personnel.
They shared their insights on the general principle of good administration ‘audi alteram partem’ , with a focus on the difficulties in the context of a dismissal for serious cause. They also presented a case law overview on how Belgian civil courts uphold and sanction violations of ‘audi alteram partem’ by public administrations.
Sofya and Liesbeth’s presentation also included practical tips for public sector employers’ on how to harmonize the obligation to hear the staff member in the context of a dismissal for serious cause.
