INHOUD
Dit seminarie wordt georganiseerd in samenwerking met Intersentia.
De publieke sector in België stelt ongeveer een miljoen mensen tewerk. Hun rechtspositie verschilt naargelang zij als statutair ambtenaar of als contractuele werknemer tewerkgesteld zijn. Hoewel deze laatste groep blijft groeien, zal het statuut van ambtenaar niet snel verdwijnen.
De sprekers zullen vanuit hun expertise in het bestuursrecht en het arbeidsrecht een aantal actuele thema's en trends met betrekking tot overheidspersoneel toelichten. Er zal aandacht worden besteed aan het huidige wettelijke, regelgevende en jurisprudentiële kader en de daaruit voortvloeiende uitdagingen voor statutair en contractueel personeel, terwijl de sprekers ook een vergelijkende blik zullen werpen op de private sector.
De volgende onderwerpen komen tijdens deze studiedag aan bod:
- Ontslag van statutair en contractueel overheidspersoneel om redenen die aan de werknemer kunnen worden toegerekend.
- De toetsing van dit ontslag door de arbeidsrechtbanken m.b.t. contractuele personeelsleden en door de Raad van State m.b.t. statutaire personeelsleden.
- De toepassing van publiekrechtelijke waarborgen (bv. beginselen van behoorlijk bestuur) op het ontslag van contractueel overheidspersoneel.
- Het personeel toepassinggebied van het recht op collectieve actie: is het van toepassing op het voltallige overheidspersoneel?
- Stakingsrecht, opvordering, minimumdienst en gegarandeerde dienstlevering.
- De toepassing van het juiste wettelijke kader voor de arbeidstijd: arbeidswet of arbeidstijdwet?
- Registratie van de arbeidstijd.
- Arbeidstijd en telewerk.

CONTENT
This seminar is organised in collaboration with Intersentia.
The public sector in Belgium employs approximately one million people. Their legal situation differs depending on whether they are employed as statutory civil servants or as contractual employees. Although the latter group continues to grow, the status of civil servants is not set to disappear any time soon.
The speakers will use their expertise in administrative law and labour law as a starting point to explain a number of current topics and trends relating to civil servants. Attention will be paid to the current legal, regulatory and jurisprudential framework and the resulting challenges for statutory and contractual personnel, while the speakers will also take a comparative look at the private sector.
The following topics will be discussed during this seminar:
- Dismissal of statutory and contractual government employees for reasons attributable to the employee.
- The review of such dismissal by the labour courts for contractual staff members and by the Council of State for statutory staff members.
- Application of public law safeguards (e.g. principles of good governance) to the dismissal of contractual public sector personnel.
- The scope of application of the right of collective action: does it apply to all civil servants?
- Right to strike, requisitioning, minimum service and guaranteed service.
- The application of the correct legal framework for working time: Employment Act or Act on Working Time?
- Working time registration.
- Working time and teleworking.
