Stéphanie De Somer, of counsel at VOW and FWO post doctoral reseacher and part time lecturer at Antwerp University and visiting lecturer at Brussels University (UB) will speak at the annual two day seminar on public sector personnel organised by IFE on 26 and 27 March 2020 in Brussels.
Stéphanie will discuss the safeguards under public law applicable to the dismissal of contractual government staff on 26 March. In her presentation she will adress topics like:
- How do the Labour Courts comply with the case law of the Constitutional Court in relation to the application of the hearing requirement before the dismissal?
- What practical points of attention should boards take into account when applying the hearing obligation before the dismissal?
- What other principles of good administration are applied by the case-law to the dismissal of contractual government staff?
- Following the case law of the Constitutional Court, is there now also an obligation to provide formal reasons for a dismissal? If so, how to deal with this in practice?
